Supreme Court Ruling LWOP for Juveniles

Hey all:

This will be a short post. I realized that I got so excited over the Supreme Court’s ruling mandatory Life Without Parole sentencing for juveniles unconstitutional I forgot to give you the text like I usually do. So, without further delay, here is the decision in Miller v. Alabama.

Here’s hoping it saves Cristian Fernandez from a terrible fate.

Supreme Court Saves Kids Lives

I found this bit of idiocy on the web today:

“Hopefully the right thing will happen and the juveniles who desire to stay in prison for life will stay in prison,” Bondi said. (emphasis mine). WTH? Who desires to stay in prison for life???

In case you don’t know, Bondi is referring to the amazing Supreme Court decision that came down on Monday, letting the states know that it constitutes an 8th Amendment violation to sentence juveniles to mandatory Life Without Parole (LWOP).  I, for one, am very glad to see this happen. It seems to me that sometimes youth get sentenced more harshly than adults who commit the same crimes.

I think the reasoning boils down to “because we can”. It’s “in loco parentis” gone wild.

But don’t think Pam Bondi stops with wishful thinking about how wonderful youngsters find the Florida prison system. She’s not content until she paints Florida youth as some kind of raging torrential virus rampaging across the state. I don’t know what’s in the water down there, but as far as she’s concerned, we should all be VERY AFRAID of the kids:

“I’ve seen firsthand juveniles commit some of the most egregious, gruesome crimes imaginable,” Bondi said.

Huh. That’s interesting. She must have a reason for encouraging Florida residents to quake in their boots at the sight of a teenager. The crime statistics there must be out of sight amazing to behold.

Except that they’re not. In fact, it turns out that juvenile crimes, even really violent ones, have been on the decline across most counties in Florida. Did I learn this from some site run by wacko leftist socialists? 🙂 Nope. These stats are provided to you by the Juvenile Justice Division of Florida. Here, take a look at the summary:

Felonies dropped by six percent, and even violent felonies have been enjoying a three year decline. Not exactly the picture of a state under attack by kids who can’t be stopped.

According to the Miami Herald, 2,100 kids are currently in prison because they went to court in states where they faced mandatory life without parole sentencing for their crimes. What that meant was that the judge or jury couldn’t look at any mitigating circumstances or take anything into account. If they did it at all, then it’s LWOP for them!

This is what bothers the Supreme Court a lot. They say in the summary that life without parole as a default sentencing is a cruel and unusual punishment violation because individuals are supposed to have the right to “not be subjected to excessive sanctions“. They also hold that “punishment for a crime should be graduated and proportioned to both the offender and the offense“.

The biggest reason I find hope in this decision is the case of Cristian Fernandez. This young boy was arrested at the age of 12 and charged with the murder of his younger brother. He’s the youngest person in Jacksonville history to be tried as an adult. He’s 13 now, having spent his birthday in isolation at the Duval County Jail.

Angela Corey, who is currently prosecuting George Zimmerman, has said it’s necessary to charge Cristian as an adult in order to “protect” the rest of the community from him. Yes, by all means, let’s protect the world from this boy:

Murdering Children Because You Serve Homophobia

WTH. Seriously? A four year old boy is dead now. This article came across the wire and the story is blazing around the internet: http://www.dailymail.co.uk/news/article-2157903/Peter-Lucas-Moses-Cult-leader-pleads-guilty-murders-woman-28-boy-4.html

Little boy who was shot because an adult thought he was gay.

So this guy Peter Moses shot this young boy, whose name is Jadon. Jadon lived in the same house with him, his mother, numerous women and their children. These women were all “wives” to Mr. Moses, and he had fathered all the children. Except for Jadon.They were members of a religious sect (his wives called him “Lord”).

He thought Jadon was gay, and…well hell, the NY Daily News tells it a bit more succinctly:

“When Jadon struck another boy in the buttocks, Moses concluded it was a sign of the child’s homosexuality, and decided to “get rid of him,” prosecutors said.”

He took him in the garage and shot him in the head. Let that sink in. There is a four year old boy who will never grow up. Why? Because some adult was so threatened by the theoretical possibility of a future gay person in his house that he lost his shit and MURDERED him.

Oh, by the way, he had his other wives help him kill the boy’s mom as well. And in a serious twist of sexism? He will get life instead of the death penalty for murdering this baby because he’s turning on them in a deal. How nice for him. Asshat.

Of course this made me think real quick about another four year old boy. You know, the one who is also a member of a religious sect. The one whose parents and pastor have taught him to hate gays and sing about how they’re not going to Heaven. Because you see, the two things are related. When people think God says you’re worthless, it’s easy for them to act like you’re worthless. Which leads to things like a 4 year old baby getting murdered.

But just in case you are under the wildly mistaken notion that this is an isolated incident, it’s not. Come, take a little walk with me across the internet.

Citizenship Is In Short Supply Or Something

Good Lord. *sigh*

MILFORD, N.H.—Mitt Romney said he believes President Obama’s decision to allow as many as 800,000 young illegal immigrants to apply for work permits and temporary legal status will ultimately make it harder for immigrants to gain permanent citizenship.

Okay, as always, let’s look at what’s really being said here.

If these youngsters are allowed to stay, it’ll be harder for other immigrants to become citizens.

Because why?

Perhaps the immigration people have only printed out 800,001 applications. So once these young folks have filled theirs out, only one more person can apply. Then the rest have to wait until our government printing office can make more.

No, it can only be one thing.

Mitt Romney is coming from his very special place of privilege again. He’s trying to win a campaign by waving the specter of “not enough for everyone if you get some”. That’s how a lot of the super wealthy work. Keeping the rest of us divided and fighting each other by acting like there isn’t enough lets them get away with whatever they want to do.

In this case:

Making false scarcity arguments about a big step forward Obama has made keeps people from understanding that Romney has no plan.

So today American politics carried on as it has been for years. Obama did something, and a leading Republican whined about it while offering nothing but vague mumblings & distractions in return. Yawn.

Zimmerman’s Bond Revoked

Gee, who would have thought George Zimmerman was a huge lier?

As most of the world knows by now, he’s had his bond revoked and has to turn himself in by Sunday. Of course he gets a ton of time to report back instead of having to come back to jail immediately like any other person. Must be nice to have friends in high places.

I won’t say too much else, just show you the actual court filing. Here in these papers, you can see the extent of the lies he and his wife told. They also have transcripts of jail conversations the two of them have had.
